Invention, Intellectual Property and Income

Tenth week's Assigment

For this week, the assignments to be accomplish are:

Invention and Intellectual property

In my case I'm re-designing a lightsaber which has been a product since the movie Star Wars "New Hope" in the year 1977, as acfictional weapon sword like used by the main characters.
Since then multiple ocassion people have try to replicate and commercialize this item, the movie and everything related to is copyright to LucasFilm and now Disney!
Funny thing about this week is that I found out the LucasFilm has sued few people including the goverment of USA hehe!! (lightSabers too) Here but in my case I openly disclaimed that my creation was yes influence from the movies yet not trying to commercialize and all the rights of the original design belong to lucasFilm and Disney; however, electronics schematics, 3D models are under the protection on creative commons as open source

this product was created for the whole purpose of education not itending to commercialize or obtain profit, but the emocional attachment that has to increase the chances to finishing the academy.(personal incentive)

After going to the Creative commons website and go to creativecommons you can share your proyect and give any kind of atributes as I did as Attribution + Noncommercial + ShareALikeCreative Commons License since I will like to share, non commercial but also I would like to get credit for all the hard work, since I can't add a copy right to an already owned product.

Any other atempt to do from this work might result on copyright infringement from the original Light Saber.

Expectations (dream Big)

The only expectations are that Neil keep his word and send this website's link the his friend and for some kind of miracle they like what they see and my design become part of the cannons! that would be an honor for any starwars fan!!

Patents

For the sake of knowledge and understand I went to seek information about patents, It was a huge dissapoitment, just like Neil talked in the class.
In order to be able to get your invention patented, you need to, 1) check if your invention is "new" 2) check if your invention is not obvious and 3) check if it make sense/possible (altough Neil explain that the lack of people with the knowledge in the matter, some inventors get nonsense patents like time traveling, vacum energy etc...)
Also, you need to check that if nobody else file the same invention before you, because it doesnt matter if you have an idea the person the file first with be granted to patent. This is called "first to file".
Let's pretend that I have all the requirements that I just describe, it's original non obvious and it works great and as far as I know nobody had this idea before. so, I successfuly patent my Idea and a big company does something suspiciusly too alike mine, aha!! I can use my patent right? yes, but the patent will give access to fight for you patent in court not to claim for the design and usability of your product!!, as we a just normal mortal humans with no much money most probably that the company using our beautiful invention migh win!!... conlcusion dont invent anything if you are poor!! hahah Joking!! CC creative commons!!!
